Poolside decks and pool fence compliance

Poolside is our bread and butter out east, and it’s also where decks go wrong. A pool barrier has to stand at least 1200mm above the finished ground level on the pool side, with no gap over 100mm underneath and a 900mm non-climbable zone kept clear. Build a deck up against an existing fence and you’ve just raised the finished level — a barrier that passed last year can quietly stop complying, and deck structure, steps or built-in bench seating inside that non-climbable zone give a kid a foothold.

We set the deck height and the barrier line together at design stage, not after the boards are down. Sometimes that means the fence moves, sometimes it means the deck steps down before it reaches the barrier, and sometimes it means glass panels reset at the new level. Whichever it is, you’ll hear it at the consultation rather than from an inspector.

There was no deck here at all. The owners had a pool sitting in a sandy backyard with nothing around it, and they wanted the whole area to work as one space rather than a pool with some ground next to it.

Sandy ground and a pool are both hard on a substructure, so we didn’t cut corners under the boards. The frame is H4-treated throughout — rated for in-ground contact and carrying a 50-year warranty — with stainless steel attachments right through. That’s the part nobody sees and the part that decides whether a deck is still solid in twenty years.

On top, the owners chose Millboard Enhanced in Burnt Cedar. It picked up the colours already in the yard, but it lifted the whole area at the same time — warmer and richer than what was there. Millboard is moulded from real oak so it reads like timber underfoot, it won’t fade or splinter in the salt air, and it grips when it’s wet, which matters when the deck is also the pool surround.

We also built in a spa at the back of the pool area, so they get the use of the space on a balmy night, not just on a hot afternoon.

Beachside — Bondi, Bronte, Tamarama, Clovelly, Coogee, Maroubra. Full salt exposure. Composite and stainless fixings as standard; hardwood only where you’re happy with the oiling routine.

Harbourside — Vaucluse, Dover Heights, Rose Bay, Double Bay, Bellevue Hill. Steep blocks and view lines. Usually elevated or split-level decks, structural framing and balustrades designed not to cut the view in half.

Councils and approvals

Depending on your suburb you’ll be dealing with Waverley, Randwick City or Woollahra.

Plenty of decks never need a DA. A deck can qualify as exempt development where it sits behind the front building line, stands no more than 1 metre above ground level, is set back at least 900mm from every boundary, and stays within the floor area limits in the NSW rules. Above 1 metre, closer than 900mm to a fence, or bigger than the threshold, and you’re into a complying development certificate or a full DA.

Heritage is the big one out east. If your property is a heritage item or sits in a heritage conservation area, the exempt pathway is off the table regardless of size — it goes to a DA. Large parts of Paddington and Woollahra are conservation areas, and there are pockets through Bondi, Randwick and Waverley. That’s not a reason not to build; it’s a reason to know before you order timber.

Strata or duplex? Work on common property or fixed to the building normally needs owners corporation approval before it starts, on top of the council pathway. We’ve done plenty and we’ll give your committee the drawings, materials schedule and insurance details in the form they actually want.

That’s why they sit above the $350–$500 per square metre quoted elsewhere, which is usually materials only, or supply-and-lay by an unlicensed installer. Sloping blocks, difficult access, elevated decks, stairs, balustrades and pergolas add to the rate, and a quote that’s $200/m² cheaper usually means those things come back later as variations. What's the best decking for homes near the beach in the Eastern Suburbs?

For streets close to the ocean we usually recommend composite boards like Trex or Millboard — salt air won't fade or corrode them, and there's no yearly oiling. If you love real timber, spotted gum and blackbutt perform well coastal-side with the right finish. We use stainless steel fixings near the water as standard.

Do I need council approval for a deck in the Eastern Suburbs?

Often not. A deck can qualify as exempt development where it sits behind the front building line, stands no more than 1 metre above ground level and is set back at least 900mm from every boundary, and where it stays within the floor area limits in the NSW exempt development rules. Above 1 metre, closer to a boundary, or on a heritage item or land in a heritage conservation area — which covers much of Paddington, Woollahra and parts of Bondi and Randwick — you'll need approval through a complying development certificate or a development application. How long does an Eastern Suburbs deck project take?

Most decks take one to three weeks on site. Tight access — common on terrace blocks — can add a little time, which is why every project starts with a plan specific to your site, so you always know where things stand.

Can you build a deck around my pool and still meet the pool fence rules?

Yes, but the deck has to be designed around the barrier from the start. Under AS 1926.1 a pool barrier must stand at least 1200mm above the finished ground level on the pool side, with no gap over 100mm at the bottom and a 900mm non-climbable zone kept clear. Raising a deck next to an existing fence raises that finished level, so a compliant 1200mm barrier can quietly become non-compliant — and deck structure, steps or built-in seating inside the non-climbable zone create a foothold. We set the deck height and the barrier line together, and we'll tell you up front if your existing fence needs to move or grow.

My house is in a heritage conservation area — can I still build a deck?

Usually yes, but not as exempt development. Land that's a heritage item or sits in a heritage conservation area falls outside the exempt pathway, so the work goes through a development application with your council. In practice that means drawings, a statement addressing the conservation controls, and a deck design that sits comfortably behind the original building line rather than competing with it. Large parts of Paddington and Woollahra are conservation areas, and there are pockets through Bondi, Randwick and Waverley — we've worked in them and can tell you what to expect before you spend anything.

How do you get materials in when there's no rear lane access?

Terrace and semi blocks out east often have no rear access at all, so everything goes through the house or over the roof. We plan the access route at the consultation — board lengths chosen to turn the corners, floor protection through the hallway, deliveries staged in smaller loads rather than one pallet on the nature strip, and a skip permit arranged with the council where kerbside space is metered or restricted. It's slower than a wide side gate, but it's normal work for us and we price it honestly rather than discovering it on day one.

Does salt air mean more maintenance on an Eastern Suburbs deck?

On timber, yes. A hardwood deck within a few streets of the water wants a fresh coat of oil roughly every 12 months rather than every 18 to 24, and a rinse-down after a big blow keeps salt from sitting in the grain. Composite is the reason most beachside clients go that way — Trex and Millboard need a wash, not a re-coat. Whichever you choose, the fixings matter as much as the boards: we use stainless near the water because galvanised will bleed rust streaks within a season.

Can you build a deck on a strata or duplex property?

Yes, and we've done plenty. Work on common property or anything fixed to the building normally needs owners corporation approval by resolution before it starts, on top of whatever council pathway applies. We'll give you the drawings, materials schedule and insurance details in the form a strata committee actually wants to see, which usually saves a meeting cycle.

Can you deck over a concrete slab, a garage roof or a courtyard?

All three are common jobs in the Eastern Suburbs. Over a slab or courtyard we build a low-profile subframe with adjustable pedestals so the finished deck clears drainage falls and doorway thresholds without digging anything up. Over a garage or a habitable room the waterproof membrane governs everything — we don't penetrate it, we work off pedestals and keep access to the drainage points, and we'll ask for a structural engineer's sign-off on the load before we start.
